Considering this film wasn't even made in America I wish them luck. A bit outside the DOJs jurisdiction. Besides, William Barr is too busy being Donald Trump's butler to bother pestering Netflix.
I must've missed the topless scene. Anyone know what the hell that tool Ted Cruz is talking about? Someone should ask him how much of the movie he scrutinized frame by frame to find that exposed breast.

It refers to a scene from the Sweetie Swaggs, the rivals of the Cuties, the girls watch a dance video of the aforementioned and one of them does an Oops, the age of the actress is unknown or the actresses seem to be teenagers.
Surely those politicians did not bother to sue Houndog because in the movie they raped Dakota Fanning

Thank you Sully, I couldn't remember any nudity but with your keen eye I quickly found it at the 28 minute mark. Just to get a look at the girls, this is pre-flash by a few frames, girl on the right:

These girls are definitely much older (that was the whole point, the 11-year-olds admired them), but I recommend people watch the whole movie to see that ONE SECOND flash and do their own Tanner Stage evaluation.

Hounddog certainly got plenty of criticism, and the director did confer with North Carolina prosecutors, but I can not find any indication of legal trouble for the makers or distributors. For some people, the sight of a bare breast is far more offensive than any kind of violence. I do not believe any United States court will find a bare breast rising to the level of CP, but of course the whole point of Senator Cruz's actions ... never mind,
politics.

Ted Cruz is a simpering Trump suckup and professional grandstander like most politicians. The purpose of this contrived outrage is for his constituents to
see him being outraged.
Cuties was filmed in France. Its producers are outside the jurisdiction of US authorities - and even if the girl in question was herself 11 yo a mere shot of her bare chest wouldn't qualify as illegal. There have to be actual sex acts involved. That rape scene in
Hounddog didn't involve any real contact, it was all acting, hence no legal violation. The main reason you don't see topless scenes involving underage actresses in the US is the negative PR - and the angry boycotts - such things generate here.
Child Bride was recently released on bluray, an American film being re-released in America, which has a lengthy scene involving a naked 12 year old. That disc is perfectly legitimate to sell here. And it wouldn't be against the law to film a similar scene today. No studio would do it though. Even if they tried, no parent would be likely to let their daughter participate. Different times. Senator Cruz (who should be busy doing his job instead of being a movie critic) probably knows damn well there's no legal case. Netflix has plenty of lawyers on retainer who would've warned them about content that violated US law. He's just playing the old morality/obscenity card to pander to evangelicals.
