I don't think you need to connect through the same server as the user who has the file you're downloading. At least, not if you're both connected to Kad as well.

Emule's servers seem to have had problems lately.

eMule's servers are gradually going away. After all, the platform is 20 years old if you count the eDonkey time. If you create a shortcut to the following, it will automatically update your server list:

ed2k://|serverlist|http://upd.emule-security.org/server.met|/
