Post I did it to continue discussing Brooke Shields and her photo in NYT.

This photo tries to explain a topless as a mental game, they see that first apparently the model is naked but then in the end she is dressed, it only challenges our imagination, very similar to Miley Cyrus and her supposed topless when she was already a star of Hannah Montana.

The problem with the picture from NYT is that people knew that the series that picture was from was all nudes

Why do American media have a problem with child nudity? but when Gary Gross died The New York Times had no problems with including this photo (uncensored) with the obituary.

The first photo as a reference to explain that a topless is not necessarily a nude, in the photo of Brooke if you do not see beyond her shoulders it is totally legal for New Yor Times (NYT)

Even though they had the picture of her with her nipples in view, would they still class it as legal?

If they'd shown a cropped version like this then it could be considered as perfectly legal

She was 10yr old and her body doesn't start to develop at 12yr by that time it could be 13yr and rarely some girls start puberty from their 10th birthday, and this time is possible from 9yr something scary, but going back to Brooke we only see similar to a 'male nipple' is not comparable to her scenes in Pretty Baby so NYT did not give it relevance unless it used another explicit photograph.

To close this discussion I don't think she should be considered topless, a girl under 10yr old don't wear her shirt unless her chest starts to change.
